On April 30, 2026, Azucena Lazalde Íñiguez, the Second District Judge for Criminal Matters in Toluca, granted an *ex officio* suspension to prevent Audias Flores Silva—alias “El Jardinero” (The Gardener) and the alleged regional boss of the Jalisco New Generation Cartel (CJNG)—from being handed over to the United States until the *amparo* proceeding filed by the detainee against his extradition is resolved.
The judicial ruling stipulates that “matters shall remain in their current state” until the *amparo* petition is resolved via a final, enforceable judgment, according to the order published in the court’s official docket. Judge Lazalde Íñiguez further determined that Flores Silva’s personal liberty shall remain under her authority and that the extradition process shall be subject to the jurisdiction of a control judge.
According to the Federal Government, a provisional arrest warrant for the purpose of extradition to the United States is currently pending against Flores Silva on charges of criminal conspiracy, crimes against public health (drug-related offenses), and illegal possession of a firearm. However, no hearing related to the extradition proceedings has yet taken place.
The judge has commissioned a court clerk to visit “El Jardinero” at the Altiplano Prison to request that he ratify—by signing—the *amparo* petition filed on his behalf. Should he fail to do so, Judge Lazalde Íñiguez will deem the petition as never having been filed, and the suspension will be rendered null and void.
The judge also warned federal authorities that, should they violate the suspension order, they could face criminal charges punishable by three to nine years in prison for contempt of court.
Flores Silva was arrested on April 27, 2026, at the El Mirador ranch in the municipality of La Yesca, Nayarit, during an operation conducted by the Navy. According to federal authorities, he served as the head of security for Rubén Nemesio Oseguera Cervantes—alias “El Mencho”—who died on February 22, 2026, in Tapalpa, Jalisco; consequently, Flores Silva was identified as one of the probable successors to lead the CJNG.
On April 29, 2026, the Attorney General’s Office (FGR) charged Flores Silva with the crimes of carrying firearms and possessing ammunition designated for the exclusive use of the Army; during a hearing that same day, a control judge ordered his placement in preventive detention at the Altiplano prison.
During the same operation on April 27, 2026, National Guard agents arrested César Alejandro “N”—known as “El Güero Conta” and identified as Flores Silva’s financial operator—in the Jardines Universidad neighborhood of Zapopan. At the time of his arrest, authorities seized a rifle loaded with 60 rounds of ammunition, methamphetamine, and cash.
César Alejandro “N” remains in preventive detention after the FGR charged him with carrying a firearm designated for the exclusive use of the Army, drug-related offenses (specifically possession of methamphetamine with intent to distribute), and engaging in financial operations with funds of illicit origin. His defense counsel requested an extension of the constitutional deadline for a ruling; consequently, the judge deferred the decision regarding whether to formally indict him and ordered his transfer to the Metropolitan Detention Center in Puente Grande. According to Omar Hamid García Harfuch, head of the Federal Secretariat of Security and Citizen Protection (SSPC), “El Güero Conta” is accused of laundering funds derived from illicit activities through companies and front men, as well as of acquiring aircraft, vessels, homes, and ranches, and investing in tequila production companies.
The judicial suspension comes in the context of a Federal Government practice that, since 2025, has involved expelling dozens of alleged Mexican drug traffickers to the United States without a definitive extradition ruling and without specific legal grounds under domestic law.
