One of the most recent arrests was this week, when five individuals, who said they belonged to the criminal group La Empresa, were released after a judge declared their arrest illegal.
With the release of six individuals who were arrested on October 22 during a coordinated operation between the State Investigation Agency (AEI) and the Municipal Public Security Directorate (DSPM), a total of 16 individuals linked to criminal groups have been released since June 2023 to date. These latest detainees claimed to belong to the criminal group known as La Empresa.
The most recent arrest took place mid-week, where five of those arrested faced charges for crimes against health, and one more was arrested for disobedience and resisting arrest. However, a control judge ordered their immediate release, declaring their detention illegal.
The operation on October 22 involved elements of the AEI attached to the District Attorney’s Office of the Central Zone and the DSPM, who arrested five people for crimes related to public health, who will also be investigated for their possible participation in recent homicides in the city.
During the operation, the officers were involved in a traffic accident with a GMC Sierra vehicle. When the officers attempted to stop the vehicle, it struck the officers, which led to a pursuit that culminated in the arrest of the vehicle on Paseos Ecuestre Avenue, at the intersection with Paseos del Árabe, in the Paseos del Camino Real neighborhood.

On board the vehicle were the subjects who identified themselves as José Manuel B. S. (25 years old), Jesús Alejandro G. C. (23 years old), Carlos Omar B. M. (23 years old), Jazheel Genaro C. L. (24 years old) and Antonio Servando B. M. (21 years old), who said they were members of the criminal group known as La Empresa.
During the search, they were seized a bag containing marijuana, weighing 0.224 grams, as well as eight plastic wrappers containing cocaine, with a total weight of 10 grams. Two Motorola and Samsung cell phones were also seized.
On September 23, a judge ordered the release of seven individuals allegedly belonging to “La Línea” who had been detained near Ojinaga with firearms. The decision was due to the fact that the judge didn’t declare the detention legal.
Initially, three of the four individuals were released after it was determined in the initial hearing that they had not committed any crime that justified their detention. In the second hearing, corresponding to the indictment, the remaining four were also released, it was concluded that the arrests were not carried out correctly.

Another similar case occurred on June 13, 2023, when a control judge decided to release three individuals detained after a violent confrontation in Villa Coronado, where seven people were killed days earlier. Those involved, identified as Sandy E. F. (SSPE cadet, 24 years old), Jesús I. H. (22 years old) and Teodoro A. I. (33 years old), were released due to an illegal search by the State Attorney General’s Office.
The release of these three suspects was based on a legal technicality related to the violation of the rights of the accused. According to reports, the ministerial authority held the detainees for an excessive amount of time without presenting them before a judge, in violation of established procedures.
