A federal judge determined that the extradition of Antonio Oseguera Cervantes, also known as Tony Montana, brother of Nemesio, also known as El Mencho, leader of the Jalisco New Generation Cartel (CJNG), is admissible. Antonio was captured in December 2022.
The judge considered that the extradition request from the United States meets the Extradition Law and the Bilateral Treaty on the matter.
According to the newspaper Reforma, who was able to review the court documents, Beatriz Moguel Ancheyta, Control Judge of the Federal Justice Center of the Eastern Penitentiary, stated that there is no doubt that the detained person is Antonio Oseguera.
The national circulation medium pointed out that the judge’s decision was sent to the Secretariat of Foreign Relations (SRE), to determine whether or not to grant the extradition requested by the US government.

‘Tony Montana’, who is currently incarcerated at the Federal Social Rehabilitation Center (CEFERESO) number 1, better known as El Altiplano, is wanted by the Federal Court of the District of Columbia, in the state of Washington, where he faces charges of conspiracy to import cocaine and methamphetamine.
He also has charges for possession of a firearm in support of the conspiracy.
The capture of Tony Montana by elements of the National Defense Secretariat (Sedena) in December 2022, occurred after one of his associates collaborated with the authorities, who revealed his location.
Since June 2013, he has been required by the United States justice system for crimes related to drug trafficking and possession of weapons, according to reports from the District of Columbia Court.
Tony Montana’s arrest was facilitated thanks to the report made by his chauffeur, who sent an email to the authorities describing the criminal operations in Tlajomulco de Zúñiga.
This information allowed the National Guard and the Attorney General’s Office (FGR) to locate and apprehend the drug trafficker. The driver also offered details about the violent behavior and mobility of Oseguera Cervantes between several municipalities including Tlaquepaque, Guadalajara, Zapopan, and Tlajomulco de Zúñiga, stating that the boss always traveled with a large convoy of vehicles and armed guards.
In addition to the driver’s statements, it was mentioned that after a previous arrest of Tony Montana in 2015, he obtained his freedom by making payments to the relevant authorities.
In September 2022, a court ruling nullified the charges for possession of military weapons against him, with Judge Abigail Ocampo Álvarez stating a lack of sufficient evidence to proceed with the accusation.
However, in January 2023, the United States Department of Justice accused him of conspiracy to traffic methamphetamine and cocaine to the United States since 1998.
Sedena described Antonio Oseguera as a potential logistic operator for the CJNG, involved in the acquisition of weapons and the coordination of violent actions against rival groups.
Furthermore, he is identified by the US Department of the Treasury as responsible for international drug trafficking and money laundering. These events highlight the continued fight against drug trafficking and the importance of interagency and international cooperation in capturing key figures of organized crime.
