A federal judge in the State of Mexico dismissed an appeal filed on behalf of drug trafficker Teodoro García Simental, alias “El Teo” or “El Tres Letras,” former head of criminal cells for the Arellano Félix Cartel.
The drug lord, incarcerated at the Federal Social Rehabilitation Center (Cefereso) No. 1, Altiplano, in Almoloya de Juárez, is complaining of a lack of medical attention from prison authorities.
The First District Court for Criminal Matters in the State of Mexico dismissed the appeal because the plaintiff must first exhaust all available remedies within the prison itself.
El Teo is complaining of the omission and refusal by the responsible authorities to provide specialized medical care and urgent treatment for the inguinal hernia he claims to suffer from.
The inmate reports experiencing “low hemoglobin, dizziness, and fainting spells with debilitating testicular pain resulting from the hernia.”
García Simental also requests timely and interdisciplinary medical care in hematology, angiology, and internal medicine, and that he be seen by a hernia specialist surgeon.
In his complaint, Teodoro also requests the provision of specialized analgesic medications such as “iron gluconate or ferrous fumarate and the performance of essential diagnostic studies.”
“Clinical analyses for low hemoglobin, inguinal CT scan, as well as ultrasound and specialist consultation, coagulation studies, and arrangements for his transfer to a tertiary care hospital,” Teo concludes in his complaint.
The judge has already notified the plaintiff of the updated grounds for inadmissibility stipulated in Article 61, specifically section XX, of the Amparo Law, which is why the complaint is dismissed outright.
Teodoro García, also known as Eduardo, Diego, and Rubén, as well as by the aliases Alamo 7, Rojo, and/or Tomatero, was arrested on January 12, 2010, in La Paz, Baja California Sur, and has been incarcerated at the Altiplano maximum-security prison ever since.
From 2017 to the present, Teo and his family have filed more than 40 appeals seeking specialized medical attention, medication, and the necessary care following surgery for a cerebral venous thrombosis.
The inmate has a 20-year prison sentence for organized crime and faces approximately 20 criminal proceedings for drug trafficking, kidnapping, and membership in the CAF (Arellano Félix Cartel). He has also received acquittals in several cases.
