The intermediate hearing that Christian Adán N, also known as “Cabo 16”, is facing in the case of the murder of photojournalist Margarito Martínez Esquivel, which occurred on January 17, 2021 in the Sánchez Taboada neighborhood of Tijuana, will resume on April 9. (He is presumed innocent until his judicial responsibility is declared. Article 13, CNPP).
The defense lawyers Leslie Denisse Morales, Pedro Enrique Díaz and Carlos Iván Durán requested Judge Leticia Lagarrañaga Vizcarra to postpone the intermediate hearing until April 9, 2024, due to the urgency in reviewing the case file and necessary digital files to prepare the defense strategy, as they were requested on January 8 and were not received until the 25th.
“The judge Lagarrañaga commented before noon on December 12th that the deferment will be made for the last time to obtain the device information they required.”
The intermediate hearing has been postponed twice due to a lack of defense lawyers for Cabo 16 or “El Jaguar”, as lawyer José Ramón Ávila Pérez did not attend the hearing on June 20, 2023 due to being ill with Covid 19 and in December he decided to absent himself without reason or response to the calls.
“Cabo 16” was arrested on February 28, 2022 in Cuesta Blanca during a series of raids in which José Heriberto Ochoa “El Huesos” and Adrián Nicolás Ramos “El Uber” were also detained. Both Ochoa and Ramos accepted a sentence of 25 years in prison and a fine of 487,000 pesos through a quick trial. Huesos and Uber had pointed out Cabo 16 as the one who hired them both to end the life of photojournalist Martínez Esquivel “for being a busybody.”
The intermediate hearing on Monday, February 12th was scheduled for 11 am, but it started at 11:45 and ended at 12. In 15 minutes, the defense was able to present their reasons for requesting a postponement of the trial against one of the suspects involved in the murder of the photojournalist.
