Just hours after Abraham Oseguera Cervantes was released from the Federal Center for Social Rehabilitation (CEFERESO) No. 1, ‘El Altiplano’, new information about the conditions under which he was released has come to light. While the federal government claims that the presiding judge, Rogelio León Díaz Villareal, ignored evidence against the brother of the leader of the Jalisco New Generation Cartel (CJNG), his legal defense warns that ‘Don Rodo’, as he is also known, is a man who solely dedicates himself to farming due to his age and some health conditions.
According to data from the Secretariat of Security and Citizen Protection (SSPC), ‘Don Rodo’ was captured during the early hours of April 21 in Autlán de Navarro, municipality of Jalisco.
The National Defense Secretariat (Sedena) reports that the 70-year-old man was captured in possession of a long weapon, an assault carbine of 5.56 x 45 caliber, a short weapon of .9 millimeters, as well as a bag containing 38 grams of cocaine, 2,011 fentanyl pills, and 255 para-fluorofentanyl pills. This occurred after the man ran to seek shelter in his home upon identifying the presence of the authorities.
However, lawyer Victor Francisco Beltrán states that the events were very different.
In an interview with journalist Azucena Uresti for Radio Formula, he explained that on that Sunday, elements of the National Guard (GN) entered the home of ‘Don Rodo’ while he and his family were sleeping.
“They enter, break the door, go into their son’s bedroom, hit him and force him to kneel. They go up to the upper floor and there was the man (Don Rodo) resting with his daughter, a girl under 10 years old who has Down syndrome, who they scared… forget it,” the defender recounted.
It was indicated that, once identified, the Armed Forces personnel took ‘Don Rodo’ to the stairs, who was walking dragging his feet due to a recent cancer operation and other medical conditions that are already affecting his quality of life, such as hypertension and diabetes.
After a several-hour initial hearing, on April 28th, Judge Díaz Villareal decided not to charge Oseguera González with involvement in the crimes of carrying firearms exclusively used by the Army, Navy, and Air Force and against health in the form of possession of fentanyl and cocaine for commercial purposes, specifically for sale.
And it is that, among other arguments, he pointed out that ‘Don Rodo’s health would not allow him to flee from the authorities or carry a firearm, as indicated in the Homologated Police Report (IPH).
Regarding this matter, Victor Francisco Beltrán states that although ‘Don Rodo’ is indeed the brother of Nemesio Oseguera Cervantes, alias ‘El Mencho’, he has no relation to his father’s illegal activities, as he is dedicated to farming.
“There is a blood relationship but they are completely dedicated to different occupations. Just because he is their brother doesn’t mean he is a delinquent person,” he pointed out in an interview for Milenio.
In that regard, he assured Abraham Oseguera Cervantes was a good man dedicated to mezcal and agave production and cultivating corn and watermelon.
On the other hand, it was highlighted that ‘Don Rodo’ was released at 1:00 on this April 30th and, after being taken to the doctor, he was transferred back to Autlán de Navarro, as he “has nothing to fear”.
